1. Product & Service

Eloquent is a communication and speaking training app available on iOS, Android, and Web (built with Flutter). Core features include:

• Onboarding and personalized profile
• AI-backed speaking coach (audio recording and feedback)
• Study content and lessons
• 30-day challenge
• Mentors and gamification (XP, streaks)
• Local notifications

2. Who We Are (Operator)

Eloquent is offered by Ferguson Muthu. For support and contact details, see Help & Support in the app or the contact information at the end of these Terms.

These Terms are governed by the laws of New Zealand. Any disputes will be resolved in the courts of New Zealand.

3. Users & Eligibility

You must meet the following to use Eloquent:

• Age: You must be at least 13 years of age (or the minimum age required in your jurisdiction to consent to these Terms). If you are under 18, you should have a parent or guardian's permission. The app may collect optional age information during onboarding.
• Region: The service may not be available in all countries or regions. You may not use Eloquent if you are in a jurisdiction where the service is restricted (e.g. due to sanctions or local law).
• Account: Use of the service is tied to your account. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.

4. Accounts & Authentication

You sign in using Google Sign-In, Sign in with Apple, or other methods we support (e.g. via Firebase Auth). When you use these providers:

• Their terms and privacy policies apply to your use of their sign-in service.
• We receive certain data from them as needed to operate the service (e.g. a unique identifier, email where provided, and display name). With Sign in with Apple, your email may be hidden or relayed.

By using these providers, you agree that we may receive and use this data in accordance with our Privacy Policy.

5. Subscriptions & Payments

Paid access is offered through Eloquent Pro (entitlement ID: eloquent_pro), managed via RevenueCat and purchased through the Apple App Store or Google Play (and any web billing we may add).

• Refunds, cancellations, and price changes are handled according to the rules of the store where you subscribed (Apple or Google). We do not process refunds directly; please use the store's refund and subscription management options.
• Restore purchases is available in the app so you can restore your subscription on a new device or after reinstall.
• We may change subscription offerings, pricing, or features with notice where required by law. Continued use after such changes may constitute acceptance.

By subscribing, you agree that payment, renewal, and expiry are governed by the terms of the platform (Apple or Google) where you made the purchase.

6. User Content & Data We Process

When you use Eloquent, you may submit:

• Audio: Recordings you upload to our backend for AI analysis and feedback
• Profile and onboarding: Goals, industry, reasons for improving, pain points, symptoms, axis preferences, name, age, gender, referral source or code, and custom context (free text)
• Usage data: Screen views and events (e.g. via analytics such as PostHog)

By submitting this content, you grant us the rights necessary to operate the service — including to process your audio and profile data to provide coaching, personalize the experience, and improve the product. You must not submit content that is illegal, infringing, or that violates others' rights. We may suspend or remove content and accounts that breach these Terms.

7. AI & Backend

Coaching and feedback are powered by our backend (with a configurable base URL). We send your audio and context to our systems for analysis and to generate feedback.

• AI-based: The coaching and feedback are generated by AI. Results are for self-improvement only; we do not guarantee any particular outcome.
• Not professional advice: The service does not provide legal, medical, or other professional advice.
• We use your content only as described in these Terms and in our Privacy Policy.

8. Third-Party Services

Use of Eloquent involves third-party services. Their terms and privacy policies apply where relevant. These include:

• Auth: Google, Apple, Firebase
• Payments/subscriptions: RevenueCat, Apple App Store, Google Play
• Analytics: PostHog (e.g. EU host)

9. Privacy & Data

Your use of the service is also governed by our Privacy Policy. By using Eloquent, you accept the Privacy Policy. It describes how we collect, use, store, and share data — including account data, onboarding and profile information, audio, analytics, and sharing with the third parties listed above.

10. Rights and Restrictions

10.1 Licence to You

We grant you a limited, non-exclusive, non-transferable licence to use Eloquent for your personal, non-commercial use (or as we otherwise permit).

10.2 Restrictions

You agree not to:

• Reverse engineer, decompile, or attempt to extract source code from the app or service
• Scrape, automate access, or resell the service
• Use the service for any illegal or abusive purpose
• Circumvent the paywall, subscription logic, or any access controls
• Infringe our or others' intellectual property or rights

10.3 Our Rights

All rights in the app, content, branding, and technology remain with us (or our licensors). Nothing in these Terms transfers any ownership to you.

11. Disclaimers & Limitation of Liability

11.1 Not Professional Advice

Coaching and feedback are for self-improvement only. They are not legal, medical, or professional advice. Do not rely on them for decisions that require licensed advice.

11.2 "As Is"

The service is provided "as is". We do not warrant that it will be uninterrupted, error-free, or free of harmful components. To the extent permitted by law, we disclaim all warranties (express or implied).

11.3 Limitation of Liability

To the maximum extent permitted by law:

• Our total liability for any claims arising from or related to the service shall not exceed the amount you paid us in the 12 months before the claim (or, if no payment, one hundred US dollars).
• We are not liable for indirect, incidental, consequential, special, or punitive damages (including loss of data, profits, or goodwill), even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow certain exclusions or limitations; in those cases, our liability is limited to the fullest extent permitted by law.

12. Changes & Termination

12.1 Changes to the Terms

We may update these Terms from time to time. We will notify you of material changes (e.g. in the app, by email, or by posting the updated Terms). Continued use after notice (or after posting, where permitted) constitutes acceptance of the updated Terms. For material changes, we may require you to accept the new Terms before continued use.

12.2 Termination

We may suspend or terminate your account if you breach these Terms or at our discretion. You may stop using the app at any time and may delete your account. To request account and data deletion, see Delete account & data. What happens to your data on termination (e.g. retention, deletion) is described in our Privacy Policy.

13. General Legal

• Governing law and venue: These Terms are governed by the laws of New Zealand. Any disputes shall be resolved in the courts of New Zealand.
• Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
• Entire agreement: These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the service and supersede any prior agreements.
